roaml Terms of Service

These Terms of Service ("Terms") govern your access to and use of the roaml mobile application and any related services (collectively, the "App"), operated by Tyler Luedtke ("we," "us," or "our"). By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use roaml. By using the App, you represent and warrant that you meet this age requirement. If you are between 13 and 18, you represent that your parent or guardian has reviewed and agreed to these Terms on your behalf.

2. Your Account

To use roaml you must create an account using a valid phone number, or sign in with Google or Apple. You are responsible for:

• Providing accurate and current information during registration
• Keeping your account credentials secure and not sharing access with others
• All activity that occurs under your account
• Notifying us at hello@roaml.app immediately if you believe your account has been compromised

You may only create one account per phone number. Accounts are non-transferable.

3. SMS Messaging

When you register or sign in using your phone number, you consent to receive a one-time SMS verification code (OTP) from roaml. By providing your phone number and requesting a code, you agree to receive that SMS.

• roaml sends SMS only for account verification — never for marketing or promotions
• To stop receiving SMS from roaml, reply STOP to any message. You will receive one final confirmation and no further messages will be sent
• For help, reply HELP or contact us at hello@roaml.app
• Message and data rates may apply. Message frequency depends on your sign-in activity
• Carriers are not liable for delayed or undelivered messages

4. User-Generated Content

roaml allows you to post check-ins, notes, ratings, photos, and reactions ("Content"). You retain ownership of the Content you create. By posting Content on roaml, you grant us a non-exclusive, royalty-free, worldwide license to store, display, and distribute that Content solely to operate and improve the App, including displaying it to your followers and in your profile.

You are solely responsible for the Content you post. You agree not to post Content that:

• Is false, misleading, or fraudulent (including fake check-ins)
• Infringes on the intellectual property rights of others
• Is defamatory, harassing, threatening, or abusive toward any person
• Contains nudity, graphic violence, or sexually explicit material
• Violates any applicable law or regulation

We reserve the right to remove Content that violates these Terms, without prior notice.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of these Terms
• Create accounts for the purpose of spamming, abusing, or harassing other users
• Attempt to gain unauthorized access to any part of the App or its infrastructure
• Scrape, crawl, or extract data from the App using automated means
• Impersonate another person or entity, or misrepresent your affiliation with any person or entity
• Interfere with or disrupt the integrity or performance of the App or its servers
• Attempt to reverse-engineer, decompile, or disassemble any portion of the App
• Use the App to send unsolicited messages or advertise to other users

6. Premium Subscriptions

roaml offers optional premium features available through an in-app subscription ("roaml Premium"). Subscriptions are managed through the Apple App Store and governed by Apple's payment and refund policies.

• Auto-renewal: Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date
• Cancellation: Cancel anytime through your Apple ID account settings (Settings → Apple ID → Subscriptions). Cancellation takes effect at the end of the current billing period — you retain access until then
• Refunds: All refund requests are handled by Apple. We do not process refunds directly. Contact Apple Support or visit reportaproblem.apple.com
• Price changes: We will notify you of any price changes before they take effect. Continued use after a price change constitutes acceptance

7. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the collection and use of your information as described there.

8. Third-Party Services

The App integrates with third-party services including Supabase, Mapbox, Google, Apple, Twilio, and RevenueCat. Your use of those services is subject to their respective terms and privacy policies. We are not responsible for the practices of any third-party service.

9. Intellectual Property

All rights, title, and interest in the App — including its design, code, trademarks, and branding — are owned by Tyler Luedtke. These Terms do not grant you any license to our intellectual property except the limited right to use the App as described herein. "roaml" and the roaml logo are trademarks of Tyler Luedtke.

10. Termination

We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or if continued access poses a risk to other users or the platform. You may delete your account at any time from within the App (Profile → Settings → Delete Account). Upon termination, your license to use the App ends and your data is deleted as described in our Privacy Policy.

11. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. Venue information displayed in the App is sourced from third-party mapping providers and may not always be accurate or up to date — we make no representations about the accuracy of venue data.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Tyler Luedtke shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, even if advised of the possibility of such damages. Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid us in the twelve months preceding the claim, or $100, whichever is greater.

13. Indemnification

You agree to indemnify and hold harmless Tyler Luedtke from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising out of your use of the App, your Content, or your violation of these Terms.

14. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Travis County, Texas.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of the App after changes are posted constitutes your acceptance of the updated Terms. For material changes, we will make reasonable efforts to notify you within the App.
